By downloading, installing, or using Memory Spark ("the app"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the app.
Description of Service
Memory Spark is a photo-based AI art generation app. It scans your photo library for images containing people, selects random photos, and uses artificial intelligence to create artistic images inspired by those memories. The app is provided by Hasan Burak Dümer ("we", "us", "our").
User Requirements
You must be at least 13 years old to use Memory Spark. By using the app, you confirm that you meet this age requirement. If you are under 18, you should review these terms with a parent or guardian.
Photo Library Access
Memory Spark requires access to your device's photo library to function. By granting photo access, you confirm that you have the right to use the photos in your library. All photo processing occurs on your device — your photos are never uploaded to any server. Only text descriptions of scenes are sent to AI services for art generation.
AI-Generated Content
- AI-generated images are provided "as is." We do not guarantee any specific artistic quality, accuracy, or outcome.
- Generated images may not accurately represent the original photos and are artistic interpretations only.
- You own the AI-generated images created through your use of the app and may use them for personal, non-commercial purposes.
- We are not responsible for how you use or share generated images.
Subscriptions & Purchases
- Free Tier: Includes limited daily generations with watermarked output and ads.
- Pro Subscription: Offers unlimited generations, all art styles, no watermarks, no ads, and HD quality. Available as weekly ($4.99/week), monthly ($9.99/month), or yearly ($49.99/year) plans.
- Credit Packs: Consumable in-app purchases that provide additional generation credits.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel subscriptions in your device's account settings (App Store or Google Play).
- Refunds are handled by Apple (App Store) or Google (Google Play) according to their respective refund policies.
- Free trial eligibility: if a free trial is offered, any unused portion is forfeited when you purchase a subscription.
Acceptable Use
You agree not to:
- Use the app to generate illegal, harmful, or offensive content
- Attempt to reverse-engineer, decompile, or extract source code from the app
- Circumvent any technical limitations or security features
- Use the app in any way that violates applicable laws or regulations
- Redistribute, resell, or sublicense the app or its content
Intellectual Property
The Memory Spark app, its design, logo, name, and all associated materials are the property of Hasan Burak Dümer. You are granted a limited, non-exclusive, non-transferable license to use the app for personal purposes in accordance with these terms.
Disclaimers
- The app is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not warrant that the app will be uninterrupted, error-free, or free of viruses.
- AI generation depends on third-party services (OpenAI) which may experience downtime or changes beyond our control.
- We are not responsible for any content generated by the AI system.
Limitation of Liability
To the maximum extent permitted by law, Hasan Burak Dümer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, loss of profits, or damage to your device.
Termination
We may terminate or suspend your access to the app at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties. You may stop using the app at any time by uninstalling it.
Changes to Terms
We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of the app after changes constitutes acceptance of the revised terms.
Governing Law
These terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
